Terms of Service

These terms cover your use of the Spellexi marketing website (spellexi.com) and the Spellexi iOS app. By using either one, you're agreeing to what's below. We've tried to write this in plain language. If anything is unclear, email us and we'll explain.
Who can use Spellexi
Spellexi is built for parents and legal guardians of school-age kids. To create an account, you need to be at least 18 years old and the parent or legal guardian of any child whose profile you add. Kids don't sign up for Spellexi themselves and don't have their own logins. The parent runs the account and is responsible for everything that happens under it.
What Spellexi is
Spellexi is a spelling practice app. You take a photo of your child's handwritten spelling work, we grade it, and we use the results to decide which words to bring back in future sessions. The marketing website (spellexi.com) describes the product, explains how it works, and lets you join the Founding Families early access list.
Beta status
Right now, Spellexi is in beta. That means the app is still being shaped. Features may change, things may occasionally break, and we may add, modify, or remove functionality as we learn what works for families. We do our best to give Founding Families a stable experience, but the app is being actively developed and isn't a finished product yet. If something isn't working, please tell us; that's a big part of what the beta is for.
Your account
When you create an account, you're responsible for keeping your login credentials secure and for everything that happens under your account. If you think someone else has accessed your account, email us so we can help.
We may suspend or close accounts that violate these terms or that are being used in ways that harm other users, the service, or Spellexi itself. If we ever do this, we'll tell you why.
Founding Families
Anyone who signs up during the beta is a Founding Family. The promise we make to Founding Families is two things:
- You pay nothing during the beta. No card required, no charges, no surprise trials.
- When paid plans launch publicly, you lock in 50% off both the monthly and annual plans, for as long as you keep your subscription active. If you cancel and resubscribe later, the discount may no longer apply.
We'll give Founding Families advance notice before paid plans turn on, so nobody is surprised by a charge.
Subscriptions, trials, billing, and cancellation
When paid plans launch, Spellexi will offer monthly and annual subscriptions, purchased through Apple's In-App Purchase system. Current pricing is shown on our Pricing page.
- Apple processes all payments. Spellexi never sees, receives, or stores your credit card or payment information.
- Free trials may be offered for new subscribers. If a trial is active, it converts automatically into a paid subscription at the end of the trial period unless you cancel beforehand.
- Renewals. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period, in line with Apple's standard policy.
- Cancellation. You can cancel at any time from Settings → Apple ID → Subscriptions on your iPhone. Cancelling stops the next renewal; you keep access for the rest of the current billing period.
- Refunds. All refunds are handled by Apple, not Spellexi. You can request a refund directly from Apple at reportaproblem.apple.com.
- Price changes. If we change subscription prices in the future, existing subscribers will be notified in advance and given the chance to cancel before the new price takes effect.
Family Sharing
A Spellexi subscription covers up to six family members through Apple's Family Sharing, subject to Apple's terms for that feature. Each kid you add gets their own profile, word bank, and progress, kept separate from other profiles on the account.
Your content
When you upload a photo of your child's handwritten spelling work, you keep ownership of that photo. You give Spellexi a limited license to use it for one purpose: to grade the spelling, store the results so the app can track which words have been mastered, and improve our grading reliability over time. We do not sell, license, share, or publish your photos. They are not used to train AI models for third parties (see our Privacy Policy for the specifics on third-party processing).
You're responsible for making sure you have the right to upload anything you upload. Please don't upload photos that contain other people or that aren't your child's own spelling work.
Acceptable use
When you use Spellexi, please don't:
- Use the app or website for anything illegal, harmful, or abusive.
- Try to reverse engineer, decompile, or break the security of the service.
- Scrape, copy, or republish our content (word lists, teaching tips, blog posts, copy) without permission.
- Resell or sublicense access to your Spellexi account.
- Use automated tools to create accounts or interact with the service.
- Submit anyone else's child's work, or content involving another person who hasn't agreed to be involved.
We may suspend access if we see the service being used this way.
Our content
The Spellexi name, logo, app, website, word lists, teaching tips, illustrations, and other content are owned by Spellexi (or licensed to us). You're welcome to use the app and website as a paying or beta user, but you don't get any ownership of our content as part of that.
Third-party services
Spellexi uses a small set of third-party services to operate, including Apple (payments, App Store, Family Sharing), Supabase (hosting), Anthropic and OpenAI (grading and content generation), Sentry (crash reporting), Resend (transactional email), MailerLite (waitlist email), and Cloudflare (hosting). Each one has its own terms of service that apply to information processed through their platform. Our Privacy Policy lists what each one does.
Disclaimers
Spellexi is provided "as is" and "as available." While we work hard to make the app reliable and the grading accurate, we don't promise the service will be uninterrupted, error-free, or correct in every individual case. Photo-based grading involves judgment and won't always be perfect. If you see a grading error, please tell us so we can improve it.
Spellexi is a practice tool, not a substitute for professional educational evaluation. If you suspect your child has a learning difference such as dyslexia, please consult an educational specialist; our goal is to support spelling practice, not to diagnose.
To the fullest extent permitted by law, Spellexi disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Spellexi (and its operator) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the service. Our total liability to you for any claim arising out of these terms or the service is limited to the greater of (a) the amount you paid Spellexi in the twelve months before the claim arose, or (b) $50 USD.
Indemnification
You agree to indemnify and hold Spellexi harmless from claims, damages, or expenses arising from your violation of these terms, your misuse of the service, or content you submit that violates the rights of another person.
Changes to these terms
We may update these terms from time to time. If we make material changes, we'll update the "Last updated" date above and, for significant changes, notify you by email or in-app. Continuing to use Spellexi after a change means you're agreeing to the updated terms.
Termination
You can stop using Spellexi at any time. If you'd like your account and all associated data deleted, email us. We may suspend or terminate accounts that violate these terms; if we do, we'll tell you why.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of these terms or your use of Spellexi will be resolved in the state or federal courts located in California, and you and Spellexi agree to that venue.
